UKAF LIABILITY RELEASE, MEDIA, PROGRAM AND TECHNOLOGY WAIVER

PARTICIPANT AGREEMENT, WAIVER, AND RELEASE OF LIABILITY

PLEASE READ CAREFULLY – THIS IS A LEGAL DOCUMENT THAT AFFECTS YOUR RIGHTS.

By signing this document, I acknowledge and agree to the following terms, which are intended to release and protect Universal Karate & Fitness (referred to as "the School"), its owners, instructors, employees, agents, and affiliates from liability in connection with my or my child’s participation in martial arts training and related activities.

1. ASSUMPTION OF RISK

I understand that participation in martial arts training, self-defense, fitness exercises, sparring, competitions, and related activities involves inherent risks, including but not limited to, serious bodily injury, permanent disability, paralysis, or death. These risks may result from my actions, the actions or negligence of others, or the conditions of the training environment.

If the participant is a minor, I, as their parent or legal guardian, acknowledge these risks on their behalf and voluntarily assume all risks associated with their participation. I further affirm that I have discussed these risks with my child and that they understand the importance of following all safety instructions provided by Universal Karate & Fitness.

2. RELEASE AND WAIVER OF LIABILITY

To the fullest extent permitted by law, I, on behalf of myself, my heirs, assigns, personal representatives, and next of kin, hereby release, discharge, and hold harmless Universal Karate & Fitness, its owners, instructors, employees, agents, affiliates, representatives, successors, and assigns from any and all liability, claims, demands, actions, or causes of action arising from any injuries, damages, losses, or expenses sustained by me or my child, including those caused by negligence or the condition of the premises or equipment.

This waiver applies to injuries sustained during training, sparring, competitions, events, traveling to and from events, and all activities conducted on or off the premises of the School. If the participant is a minor, I, as their parent or legal guardian, understand that this waiver applies to my child and that I am responsible for ensuring their compliance with all safety guidelines and dojo rules.

3. MEDICAL RELEASE AND CONSENT TO EMERGENCY CARE

I acknowledge that martial arts and fitness activities can result in injuries that may require medical attention. In the event of a medical emergency, I authorize Universal Karate & Fitness and its representatives to obtain medical treatment for me or my child as deemed necessary, and I agree to be responsible for all associated medical costs.

If the participant is a minor, I understand that every effort will be made to contact me immediately in the event of an emergency. However, I authorize the School and its representatives to act in my absence to seek emergency medical care for my child if needed.

I further understand that Universal Karate & Fitness is not responsible for any medical, dental, hospital, ambulance, or other related expenses incurred as a result of participation in its programs.

4. INDEMNIFICATION CLAUSE

I agree to indemnify, defend, and hold harmless Universal Karate & Fitness, its owners, instructors, employees, agents, and representatives from any claims, suits, damages, losses, or expenses (including attorney’s fees) arising from my or my child’s participation in activities, including third-party claims for personal injury or property damage.

5. CONSENT TO USE OF LIKENESS (MEDIA RELEASE)

I grant Universal Karate & Fitness the absolute and irrevocable right to use my or my child's name, image, likeness, voice, and/or performance in any photographs, videos, recordings, or other media captured during training sessions, events, competitions, or promotional activities.

I understand and agree that these materials may be used for promotional, educational, or marketing purposes, including but not limited to, social media, websites, advertisements, brochures, and training materials, without compensation.

If the participant is a minor, I, as their parent or legal guardian, consent to the use of their likeness in all forms of media as described above. I waive any right to inspect or approve the finished product in which my or my child's likeness appears and release Universal Karate & Fitness from any claims related to such use.

6. RULES AND SAFETY COMPLIANCE

I agree to comply with all rules, policies, and safety guidelines established by Universal Karate & Fitness. I acknowledge that failure to follow these rules may result in removal from training without a refund.

If the participant is a minor, I agree to reinforce these rules with my child and ensure that they understand the importance of respecting instructors, peers, and dojo guidelines.

I further understand that instructors have the authority to modify training activities or deny participation if they determine that continued participation poses a safety risk to myself, my child, or others.

7. SEVERABILITY CLAUSE

If any provision of this agreement is found to be unlawful, void, or unenforceable, the remaining provisions shall remain in full force and effect.

8. ACKNOWLEDGMENT OF UNDERSTANDING

I HAVE READ AND FULLY UNDERSTAND THIS AGREEMENT. I ACKNOWLEDGE THAT I AM VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE, AND THAT I SIGN THIS AGREEMENT FREELY AND VOLUNTARILY.

IF SIGNING ON BEHALF OF A MINOR PARTICIPANT, I CONFIRM THAT I AM THE PARENT OR LEGAL GUARDIAN, HAVE THE LEGAL AUTHORITY TO ENTER INTO THIS AGREEMENT, AND ACCEPT ALL TERMS AND CONDITIONS ON THEIR BEHALF.

Enrichment Program Waiver

Applicant/undersigned agrees to indemnify and hold harmless Universal Karate & Fitness, it's officers, directors, volunteers, officials, staff and contractors from any and all liability, losses or damages whatsoever, including emotional distress, arising from participation in any other of

their programs.

I understand and hereby acknowledge that if my property is damaged, lost, stolen, or destroyed for any reason or by any cause, including but not limited to acts of god, nature, weather, fire, theft, or otherwise, Universal Karate & Fitness is not responsible.

Therefore, in such an event my only recourse will be any insurance that I have on my behalf. In case of an accident or other emergency, personnel/officers/directors of Universal Karate & Fitness are hereby authorized to secure medical care deemed necessary as a result of an accident or injury for the participant. I further agree to pay any and all costs incurred as a result of this treatment.

I hereby irrevocably consent to authorize the use and reproduction of photographs and video taping of any Universal Karate & Fitness event for promotional use or for the company's website. Such footage may be used in any manner deemed appropriate by Universal Karate & Fitness without compensation.

I also understand that this program is not required to be licensed by the Georgia Department of Early care and Learning and that this program is exempt from state licensure requirements.

Technology Permission Form and Waiver

Applicant/undersigned agrees to indemnify and hold harmless Universal Karate & Fitness, it's officers, directors, volunteers, officials, staff and contractors from any and all liability, losses or damages whatsoever, including emotional distress, arising from participation in any other

of their programs.

I understand and hereby acknowledge that if my property is damaged, lost, stolen, or destroyed for any reason or by any cause, including but not limited to acts of god, nature, weather, fire, theft, or otherwise, Universal Karate & Fitness is not responsible.

Therefore, in such an event my only recourse will be any insurance that I have on my behalf. My child(ren) has permission to bring their devices to the Universal Karate & Fitness After School program. I am aware that Universal Karate & Fitness and it's staff are not responsible for the loss, theft or damage of my child's device. I am aware that my child(ren) will be required to follow the listed technology usage rules:

1. No inappropriate websites, music, or content being streamed/watched

2. No Social Media sites/apps (Facebook, Twitter, Twitch, Tiktok, etc.)

3. No device during lunch or snack hour.

4. ALL devices & device accessories MUST be labeled with the name(s) of the child(ren).

5. Devices CANNOT be left in the wall to charge when not in use.

6. When NOT in use devices MUST be returned to the book bag/case of the child(ren) or the studio

device box.

7. No campers are allowed in the device box, ONLY staff can return devices to the child(ren).
